Terms and Conditions
Last updated: October 1, 2026
1. Introduction
Welcome to CanDo App – Suite (“CanDo App”, “we”, “us”, or “our”). By accessing or using our website, mobile applications, and related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before creating an account or making a payment.
CanDo App – Suite is a brand and service of V&S GLOBAL SUPPLY AND SERVICES (PVT) LTD (Company No. PV 00347076), a registered corporate entity operating within the Democratic Socialist Republic of Sri Lanka. References to “CanDo App”, “we”, “us”, or “our” mean that company operating the CanDo brand. Our platform connects local talent and businesses, uses local financial infrastructure, and may occasionally provide services directly through CanDo staff.
1.1 Acceptance of Terms
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of these Terms, you may not access or use the Service.
1.2 Eligibility and Age Restriction
The CanDo App – Suite (the “Service”) is offered only to individuals who are eighteen (18) years of age or older. The Service is not intended for use by anyone under 18, and we do not knowingly permit minors to register for or use the Service.
1.2.1 Confirmation on use
By accessing or using the Service, creating an account, or tapping “I agree” (or similar) to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement under the laws of the Democratic Socialist Republic of Sri Lanka. If you do not meet this requirement, you must not access or use the Service.
1.2.2 Acceptance includes data retention
Your acceptance of these Terms also confirms that you have read and understood our Privacy Policy and that you consent to the collection, use, processing, and retention of your personal data and related information (including account, verification, transaction, and usage data) as described in the Privacy Policy and as required to operate the Service, meet legal and regulatory obligations (including under the Personal Data Protection Act, No. 9 of 2022, where applicable), resolve disputes, and enforce these Terms. Retention periods may vary by data type and purpose; where the Privacy Policy or law specifies a retention period, we will retain data accordingly.
1.2.3 False age declarations
Providing false information about your age, or using the Service in breach of this section, is a material breach of these Terms and may result in immediate suspension or termination of your account and any related data handling permitted under the Privacy Policy and applicable law.
2. Nature of the Platform and Services
2.1 Venue Only (Third-Party Transactions)
For most transactions, CanDo App acts solely as an online venue and intermediary connecting individuals or businesses seeking services (“Buyers” or “Recruiters”) with independent third parties offering services (“Sellers” or “Talent”). In those cases we do not provide the underlying service and we do not employ the Sellers.
2.2 Independent Contractor Status (Third-Party Sellers)
When a Buyer engages a third-party Seller, no agency, partnership, joint venture, or employer–employee relationship is created between CanDo App and that Seller. Third-party Sellers are independent contractors. CanDo App is not responsible for withholding taxes, Employee Provident Fund (EPF) or Employee Trust Fund (ETF) contributions, workers’ compensation, or management of working conditions for third-party Sellers, except as required by applicable law for our role as platform operator.
2.3 CanDo Direct Services (In-House Staff)
In specific cases, CanDo App may offer services directly using our own employed staff or officially designated corporate agents (“CanDo Staff”).
- When a Buyer explicitly engages CanDo Staff through the Service, CanDo App is the direct service provider.
- Sections 2.1 and 2.2 (venue and independent contractor disclaimers) do not apply to those engagements.
- For CanDo Direct Services, CanDo App is responsible for its staff as employer or principal, including applicable statutory labor contributions (EPF/ETF) under Sri Lankan law, subject to the limitations in Section 10.
- The Service will indicate when fulfillment is by CanDo Staff versus a third-party Seller.
3. User Accounts
3.1 Account Creation
When you create an account, you must provide information that is accurate, complete, and current at all times. Failure to do so may constitute a breach of these Terms and may result in suspension or termination of your account.
3.2 Account Security
You are responsible for safeguarding your password and for all activities under your account. You must notify us immediately if you become aware of unauthorized access or a security breach.
- You agree not to disclose your password to any third party.
- You are responsible for all activity under your account.
- You must report unauthorized access without undue delay.
3.3 Identity and Verification
We may offer features intended to verify identity (for example, National Identity Card (NIC) validation) or credentials. We do not guarantee the accuracy, reliability, or completeness of verifications for third-party users. You are solely responsible for your own due diligence before entering into agreements with third-party Sellers.
4. User Responsibilities
4.1 Conduct
You agree not to use the Service:
- In any way that violates applicable law or regulation in Sri Lanka.
- To send advertising or promotional material without our prior written consent, where consent is required.
- To impersonate any person or entity, or misrepresent your affiliation.
- In any manner that restricts or inhibits others’ use of the Service, or that harms the platform, its users, or our systems.
4.2 Content Standards
Content you submit must not be offensive, defamatory, unlawful, or infringe intellectual property or other rights of any person.
5. Payments and Fees
5.1 Fees, Currency, and Local Regulation
You agree to pay all applicable fees for services booked through the Service. Unless we state otherwise, amounts are quoted and charged in Sri Lankan Rupees (LKR). Financial activity on the platform is subject to regulations of the Central Bank of Sri Lanka (CBSL) and other applicable authorities.
5.2 Payment Processing via PayHere
Card and other supported payments are processed through PayHere (or other payment partners we designate from time to time), an authorized payment gateway. By paying through the Service, you also agree to PayHere’s applicable terms, privacy notices, and processing rules to the extent they apply to your transaction.
CanDo App does not store full payment card details where processing is handled by PayHere; payment data is handled according to our Privacy Policy and the processor’s standards.
5.3 Initial Charges and Price Updates (Scope Changes)
Many bookings involve a quoted price at checkout. Additional amounts may be required when the agreed scope of work changes (for example, extra materials, extended hours, or add-on tasks agreed between Buyer and Seller).
Where the Service supports it:
- Further payment requests may be initiated through our integration with PayHere (including via API) for an updated or supplemental amount tied to an existing order or engagement.
- We will not charge supplemental amounts unless: (a) the need for additional payment was disclosed and explained in the Service (including description of the change and amount), and (b) the paying user confirms or authorizes the update through the Service (or other documented acceptance we provide), or (c) a supplemental charge was clearly disclosed upfront as part of the quoted terms for that booking.
- If you do not agree to a proposed price update, you may decline it; unresolved scope or payment disputes for third-party jobs are handled as in Section 9, and CanDo Direct Services through our support as stated there.
5.4 Payouts to Sellers
Payout timing, holds, and deductions (including platform fees) will be shown in the Service or seller documentation. We may delay or withhold payouts where required by law, fraud review, chargebacks, or breach of these Terms.
5.5 Non-Circumvention
You agree to use CanDo App as your exclusive method to request, make, and receive payments for work with another user that arises from or relates to your relationship on the platform, unless we agree otherwise in writing. Taking transactions off-platform to avoid fees is a material breach and may result in immediate account termination and other remedies available at law.
6. Refund and Cancellation Policy
6.1 Reporting Issues
If a delivered service does not meet agreed standards or timelines, the affected user must report the issue to CanDo App Support within forty-eight (48) hours of the scheduled delivery date or stated completion time, whichever applies, and provide reasonable detail and evidence where available.
6.2 Investigation and Remedies
After review (and, where relevant, coordination with the Seller), if we determine the service was not satisfactorily performed under the agreed terms, CanDo App may, at its discretion:
- Facilitate a refund of eligible amounts (typically excluding non-refundable platform or payment processing fees, unless required by law or stated otherwise for CanDo Direct Services), or
- Arrange a replacement or corrective service, where feasible.
Refunds, when approved, are generally returned via the original payment method or another method we specify, subject to PayHere, bank, and CBSL rules. Chargebacks initiated without following this process may affect account standing.
6.3 Cancellations
Cancellation rights depend on the booking type, Seller policies shown at checkout, and whether work has started. Specific cancellation terms will be displayed for each engagement where applicable. Nothing in this section limits mandatory consumer rights under Sri Lankan law.
7. Intellectual Property Rights
7.1 CanDo Platform and Brand
The Service, its software, design, logos, and our content are owned by CanDo App or our licensors. You may not copy, modify, or exploit them except as allowed by these Terms or our written permission.
7.2 Work Product (Third-Party Sellers)
Unless the Buyer and Seller agree otherwise in writing on or through the platform:
- Ownership of digital assets, designs, code, documentation, or other deliverables created by a third-party Seller transfers to the Buyer only upon full and final payment for the relevant service.
- Until payment is complete, intellectual property rights remain with the Seller, and the Buyer receives only the license (if any) explicitly stated in the order or messaging.
Sellers warrant they have the right to grant such transfers or licenses. Buyers must not use paid-for deliverables in violation of agreed licenses or law.
7.3 User Content
You grant CanDo App a non-exclusive, worldwide, royalty-free license to host, display, and use content you submit on the Service as needed to operate the platform, enforce these Terms, and comply with law.
8. Data Protection and Privacy
In accordance with the Personal Data Protection Act, No. 9 of 2022 (PDPA) and applicable regulations, CanDo App is committed to protecting personal information you provide (such as NIC-related data, photographs, contact details, and addresses).
We collect, process, and store personal data securely and for legitimate purposes described in our Privacy Policy (account operation, verification, payments, support, legal compliance, and platform safety).
We do not sell your personal information. We do not disclose it to third parties except:
- With your explicit consent where required;
- To service providers (such as PayHere, hosting, or verification partners) who process data on our instructions and under appropriate safeguards;
- When required by law or to protect rights, safety, and integrity of users and the Service.
You may have rights under the PDPA (such as access or correction, where applicable). Contact us using Section 15 or the channels in the Privacy Policy.
9. User Disputes
For transactions involving third-party Sellers, CanDo App is not obligated to resolve disputes between Buyers and Sellers regarding quality, timelines, or payment, except where we choose to intervene to protect platform integrity or as described in Section 6.
Users should attempt to resolve disputes in good faith through the Service’s tools and direct communication. We disclaim liability arising from interactions or disputes between third-party users, except where liability cannot be excluded by law.
Disputes regarding CanDo Direct Services should be directed to CanDo App customer support.
10. Limitation of Liability
To the fullest extent permitted by law, CanDo App and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, data, or goodwill, arising from:
- Errors or inaccuracies in user or third-party content;
- Personal injury or property damage related to third-party services or user conduct;
- Unauthorized access to or use of our systems, except where caused by our gross negligence or willful misconduct as determined under applicable law;
- Interruption, delay, or cessation of the Service;
- Actions or omissions of third-party Sellers, Buyers, or payment processors.
Our total aggregate liability for claims arising from the Service or these Terms shall not exceed the greater of (a) the fees you paid to CanDo App for the transaction giving rise to the claim in the three (3) months before the event, or (b) LKR [amount]—adjust this cap with your lawyer.
Nothing in these Terms excludes or limits liability that cannot be limited under Sri Lankan law.
11. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. CanDo App disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.
We do not warrant uninterrupted or error-free operation, or that third-party Sellers will complete work to any particular standard unless expressly guaranteed in writing for CanDo Direct Services.
12. Modifications to Terms
We may modify or replace these Terms at any time. If a change is material, we will use reasonable efforts to give at least thirty (30) days’ notice before the new terms take effect (for example, by email, in-app notice, or posting on the Service).
Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and may close your account, subject to outstanding obligations.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Colombo, Sri Lanka, for disputes arising from these Terms or the Service, without prejudice to mandatory consumer protections that may apply to you.
14. General
- Entire agreement: These Terms, the Privacy Policy, and order-specific terms shown at checkout form the agreement between you and CanDo App regarding the Service.
- Severability: If any provision is invalid, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver of our rights.
- Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization.
